This agreement is between you and Self Driving Jazz ("we", "us"), the maker of Vampire. It covers the Vampire for Mac app. By installing or using Vampire you accept it. If you don't accept it, don't use Vampire; if you bought it, ask for a refund within 30 days.
1. The license
- When you buy Vampire for Mac, we grant you a perpetual, non-exclusive, non-transferable, personal license to install and use Vampire on up to 3 Macs at a time that you own or control, for any purpose, including your work.
- Personal means the license belongs to one person. Don't share your license key, or sell, rent, lend or transfer the license. A team buys one license per person.
- Perpetual means it does not expire. It ends only as described in section 9.
- A Mac counts toward the 3 once it is activated with your key. You can deactivate a Mac from the app to free its slot. To stop key sharing we may limit how often you can do that (today, 10 deactivations in 30 days); support can reset it.
2. Updates
- A license bought under the current offer includes every future update of Vampire for Mac, at no extra cost, for as long as the license exists.
- The update terms in force when you bought are the ones that apply to your license, and we won't reduce them later. If we ever sell a paid major version, it applies only to licenses bought under that later offer.
- Updates arrive through the app's built-in updater. Installing them is your choice.
3. Trial
- Without a license, Vampire runs as a free trial with every feature for 14 days from its first launch on a Mac. The trial needs no account.
- After the trial, Vampire runs in viewer mode: you can still browse, search, view, organize, export and sync your library, and connect to a server. Adding media (import, clip, screenshot, Eagle import) needs a license.
- Don't reset or extend the trial by technical means.
4. Activation and license checks
- Activation sends your license key and a few facts about the Mac to our license server (see the Privacy policy). The server returns a signed license bound to that Mac.
- When it is online, Vampire checks its license with the server about once a day. Without a connection it keeps working fully for about four months after the last successful check, then runs in viewer mode until it can check again.
- A license that is refunded or charged back is revoked. Each Mac returns to viewer mode at its next check.
5. What you may not do
- Copy, distribute, sell, rent, lend or sublicense Vampire or your license key.
- Remove, disable or get around the license check, the trial or other technical limits, or help anyone else do so.
- Reverse engineer, decompile or disassemble Vampire, except where applicable law expressly allows it despite this restriction.
- Use Vampire to break the law or anyone's rights.
6. Ownership and source code
Vampire is licensed, not sold. We and our licensors own it, including every copy and update. This agreement gives you no rights to Vampire's source code, and no rights it doesn't expressly grant.
7. Open-source components
Vampire includes the VAMP tools vamp, vamp-server, vamp-store and vamp-media. They are open source under the MIT License (github.com/selfdrivingjazz/vamp) and they stay MIT: the MIT License, not this agreement, governs your use of them, whether you got them with Vampire or on their own. Other third-party components keep their own licenses, which this agreement doesn't change.
8. Your data
Your media and your library stay on your machines and on servers you choose. We don't receive them. Your library is in the open VAMP format, and nothing in this agreement stops you reading, exporting or moving it with any tool.
9. Termination
The license ends automatically if your payment is refunded or charged back, or if you seriously break this agreement (for example by sharing your key or getting around the license check). When it ends, Vampire returns to viewer mode. Your data stays yours.
10. No warranty
Vampire is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We don't promise it is free of errors or will run without interruption. Keep backups of your originals.
11. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or revenue, arising from your use of Vampire. Our total liability under this agreement is limited to the amount you paid for your Vampire license. Where the law doesn't allow these limits, they apply only as far as it does. Nothing here limits consumer rights that can't be waived by contract.
12. Purchase
Vampire is sold by Polar (polar.sh), the merchant of record, which handles payment, tax and receipts under its own terms. Prices are in US dollars plus VAT where applicable. Refunds are covered by the Refund policy.
13. Changes
We may publish a new version of this agreement for later purchases. A change never takes away what you already bought: use on 3 Macs for good, and updates as promised when you bought.
